Terms of Service

1. Agreement to Terms

By accessing or using Xite AI Image Editor ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Service Description

Xite AI Image Editor is an AI-powered image editing and generation platform. The Service allows users to upload, edit, enhance, and generate images using artificial intelligence technology. Features include but are not limited to: image upscaling, colorization, background generation, object detection, and text-to-image generation.

3. Age Requirement

You must be at least 18 years old to use this Service. By creating an account, you confirm that you are 18 years of age or older. We do not knowingly collect data from or provide services to anyone under 18 years of age.

4. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized account access

5. Subscription and Tokens

The Service operates on a token-based system:

• Tokens are required to perform AI operations
• Tokens can be purchased individually or through subscription plans
• All tokens (subscription and purchased) accumulate in your balance and do not expire
• Tokens are non-transferable between accounts
• We reserve the right to modify token costs for operations with reasonable notice

6. Refund Policy

Important: Tokens are only deducted from your account when a job completes successfully. If a job fails due to a system error, you will not be charged.

Due to the significant computational costs incurred through our GPU infrastructure, refunds are generally not available once tokens have been consumed. However, we may consider refund requests in exceptional circumstances, such as:

• Demonstrably poor results caused by a verified system malfunction
• Duplicate charges or billing errors
• Circumstances required by applicable consumer protection law

Where a refund is granted, we can only refund the portion of your purchase not already consumed by GPU processing costs. Refund requests must be submitted within 14 days of the transaction and will be assessed on a case-by-case basis.

7. Acceptable Use Policy

You agree not to use the Service to create, upload, or process any content that:

• Contains child sexual abuse material (CSAM) - this results in immediate permanent ban and reporting to authorities
• Depicts minors in any sexual, suggestive, or inappropriate context
• Contains non-consensual intimate imagery
• Promotes terrorism, violence, or illegal activities
• Infringes on intellectual property rights of others
• Contains malware or attempts to compromise our systems
• Violates any applicable laws or regulations

We employ automated content moderation systems to detect and prevent prohibited content. See Section 8 for details on our content safety measures.

8. AI-Generated Content

Regarding content created using our AI tools:

• You retain ownership of images you upload
• You are granted a license to use AI-generated outputs for personal and commercial purposes
• You are responsible for ensuring your use of AI outputs complies with applicable laws
• AI outputs may not be unique - similar prompts may produce similar results for other users
• We do not claim ownership of your inputs or outputs

9. Content Safety & Moderation

We take content safety seriously while respecting your privacy. Our automated moderation system includes:

• Upload Scanning: All uploaded images are automatically analyzed by AWS Rekognition to detect explicit, violent, or illegal content. This is fully automated - no human views your images.
• Output Scanning: AI-generated images are scanned before delivery to prevent generation of prohibited content.
• Age Protection: Images containing persons who appear under 16 years old are blocked from AI editing features to prevent misuse.
• Prompt Filtering: Text prompts are screened for prohibited terms related to illegal content.

Important: Your images are stored for up to 48 hours to enable editing, then automatically deleted. We do not manually review or monitor your images - all moderation is performed by automated systems.

10. Strike System & Enforcement

Violations of the Acceptable Use Policy result in the following actions:

• 1st violation: Warning issued, content blocked
• 2nd violation: 24-hour account suspension
• 3rd violation: 7-day account suspension
• 4th+ violation: Permanent account ban

CSAM Exception: Any detection of child sexual abuse material results in immediate permanent ban without prior warnings. Such content is reported to the Internet Watch Foundation (IWF) and relevant authorities.

Strikes reset after one year of no violations. Appeals can be submitted via email (see Contact section).

11. Data Storage & Retention

• User images are stored for up to 48 hours, then automatically deleted
• Flagged content is immediately deleted from storage
• Only metadata (timestamps, detection results) is retained for moderation logs
• Account data is retained while your account is active
• Payment records are retained for 6 years as required by UK tax law

12. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

13. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We do not guarantee uninterrupted or error-free service
• AI outputs may contain errors or unexpected results

14. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Violate the Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Fail to pay for subscription or token purchases

You may terminate your account at any time by contacting us. Upon termination, your access to the Service will end and your data will be deleted in accordance with our Privacy Policy.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, without prejudice to any mandatory consumer protection laws that may apply in your jurisdiction.
